Tax Debt and bankruptcy
In order to discharge tax debt through bankruptcy, the following circumstances must apply:
- The due date for filing the tax return must have been at least three years ago
- The tax return must have been filed at least two years ago
Tax debt can be eliminated by filing for Chapter 7 bankruptcy. If you file for Chapter 13 bankruptcy, you will have three or five years to pay off your back taxes.
Certain types of tax debt are not dischargeable, including Medicare withholding tax and sales tax. These issues are very case specific and you need to consult with an experienced bankruptcy attorney to understand how the law will work in your situation.
